Common pay problems we recover
- Unpaid wages or final pay after you leave
- Holiday pay calculated wrongly under the Holidays Act 2003, or annual leave not paid out
- Public holidays not paid properly, or no day in lieu given
- Overtime or hours you worked but weren't paid for
- Deductions from your pay without your written consent
- Pay below the minimum wage
How far back can you claim?
Claims for wage arrears can generally go back up to 6 years. The 90-day personal grievance limit doesn't apply to straightforward claims for money you're owed. Even so, the sooner you act, the easier the records are to get.
How we recover it
- We work out what you're owed from your payslips, rosters and agreement.
- We formally demand payment from your employer.
- If they don't pay, we take it to mediation or the Employment Relations Authority, which can also order penalties for breaches of minimum entitlements.
Common questions
I don't have all my payslips. Can I still claim?
Yes. Employers must keep wage and time records and holiday records, and you're entitled to ask for them. We can request them on your behalf.
Can I claim if I've already left the job?
Yes. Most wage and holiday pay claims we handle are for people who have already left.
