How employment mediation works
Mediation is run by MBIE's Mediation Services. It's free, confidential and "without prejudice", which means what's said can't be used against you later. It can happen in person, by video or by phone.
If you reach agreement, the mediator can sign a Record of Settlement. Once signed it's final, binding and enforceable, so it's important to get the terms right before you sign.
What we do for you
- Work out what your claim is realistically worth before you go in
- Prepare your case and talk you through what to expect
- Do the talking and negotiating on the day
- Check the settlement terms, including payments, references, confidentiality and tax treatment
If it doesn't settle: the Employment Relations Authority
The Authority investigates the dispute and makes a binding decision. Advocates can represent you there, just as lawyers can. Cases that go beyond mediation have a different fee structure, which we explain in full before you decide to go ahead.
Common questions
Do I have to go to mediation?
In most cases the Authority expects you to try mediation first. It's often the fastest and least stressful way to resolve a dispute.
What does it cost?
MBIE mediation itself is free. Our representation is no win, no fee up to and including mediation.
